Rechtliche Hinweise zur REACH-Verordnung

Liebe Kundinnen und Kunden,
wie Sie bestimmt wissen, produzieren wir unsere LaBina^®-Farben nicht nur aus besten Rohstoffen und mit gründlicher Sorgfalt, sondern legen schon immer größten Wert auf sichere, allergenarme Inhaltsstoffe und Transparenz unseren Kunden gegenüber.

Daher begrüßen wir, dass die REACH-Verordnung der EU jetzt auch für Tätowier-, Microblading- und Permanent-Make-up-Farben gilt. Durch diese Verordnung werden auch eine Reihe von Inhaltsstoffen verboten. Während dies für die Tätowierer durch das Verbot von zwei wichtigen Pigmenten (Grün 7 & Blau 15) erhebliche Konsequenzen hat, müssen wir bei unseren LaBina^®-Pigmentierfarben nur wenig anpassen.

Allerdings tritt die Änderung jetzt recht kurzfristig zum 04.01.2021 in Kraft. Der endgültige Verordnungstext wurde erst am 15.12.2020 im Amtsblatt der EU veröffentlicht. Die Vorlaufzeit ist mit 20 Tagen extrem kurz, um die ab Januar 2021 geltenden Veränderungen umzusetzen.

 

Das Wichtigste gleich vorab:
Wenn Sie LaBina^®-Pigmentierfarben benutzen, sind Sie davon zunächst nicht unmittelbar betroffen. Es gibt eine ausreichende Übergangsfrist von einem Jahr. Deswegen können Sie alle in Ihrem Besitz befindlichen LaBina^®-Pigmentierfarben bis zum 04.01.2022 ohne Einschränkungen durch die REACH Verordnung weiter verwenden.

An dieser Stelle möchten wir Ihnen zunächst einen möglichst kurzen Einstieg in die Materie vermitteln. Es hilft zu wissen, wo die maßgeblichen Vorschriften stehen und wie sie miteinander zusammenhängen.
1.) Bisher war das für Permanent Make-up maßgebliche Recht in erster Linie in der deutschen Tätowiermittelverordnung geregelt. Daneben gilt als Stand der Technik von Seiten des Europarats die Resolution ResAP(2008)1 „über die Anforderungen und Kriterien für die Sicherheit von Tätowierungen und Permanent Make-up“. Damit werden insbesondere Mindestanforderungen an Hygiene geregelt und eine Reihe von Inhaltsstoffen verboten.
2.) REACH ist eine seit 2007 in Kraft befindliche EU-Verordnung, also in allen Mitgliedsstaaten unmittelbar geltendes Recht – im Unterschied zu Richtlinien, die erst in nationale Gesetze umgesetzt werden müssen. REACH betrifft die „Registrierung, Bewertung, Zulassung und Beschränkung chemischer Stoffe“ und hat ein umfassendes System der Klassifizierung von Chemikalien aus allen Bereichen geschaffen. Ab dem 04.01.2021 gilt REACH auch für Tätowier-, Microblading- und Permanent Make-up-Farben. Über die Tätowiermittelverordnung hinaus ergeben sich bezüglich der verbotenen Inhaltsstoffe für Microblading- und Permanent-Make-up-Anbieter keine wesentlichen Veränderungen. Für Tätowierer sind die Auswirkungen viel gravierender, dort werden je nach Anbieter ab 2022 zwischen 60% und 100% der Farben wegfallen, wenn die Hersteller nicht große Teile ihrer Inhaltsstoffe austauschen.
3.) Maßgeblich für die Veränderungen ist Anlage 13 des Anhangs XVII von REACH. Dieser enthält eine Liste mit unzulässigen Inhaltsstoffen. Er ist nun durch die am 04.01.2021 in Kraft tretende Ergänzungsverordnung auf verschiedene, ausschließlich auf den Bereich Tätowiermittel, MB und PMU bezogene Stoffe erweitert worden. Das in einigen von unseren Rezepturen für die Herstellung von LaBina^®-Pigmentierfarben eingesetzte gelbe Pigment Yellow 97 [CI 11767] ist nach der Übergangsfrist ab dem 04.01.2022 nicht mehr zulässig. Das von uns verwendete Pigment Grün 36 [CI 74265] entspricht der Verordnung und darf weiterverwendet werden. Das von uns in ganz geringem Umfang ebenfalls eingesetzte Pigment Blau 15 [CI 74160] befindet sich noch in der Prüfung und darf nach derzeitigem Stand jedenfalls noch bis 03.01.2023 benutzt werden. Wir gehen jedoch davon aus, dass dieses Pigment auch nach diesem Zeitpunkt weiterverwendet werden darf, da der zuständigen Europäischen Chemikalienbehöre ECHA für die amtliche Prüfung noch nicht alle erforderlichen Daten vorliegen und sich bisher keine Hinweise auf eine Gefährlichkeit dieses Pigments ergeben haben.
4.) In den Rezepturen der LaBina^®-Pigmentfarben, in denen das gelbe Pigment Yellow 97 [CI 11767] zum Einsatz kommt, werden wir in den kommenden Wochen mit einem uneingeschränkt nutzbaren anderen Gelbpigment neue Pigmentierfarben herstellen. Die Produktion der neuen Pigmentierfarben wird bis spätestens 01.03.2021 abgeschlossen sein.
5.) Ab dem 04.01.2022 müssen Pigmentierfarben nach Vorgaben von REACH produziert, gekennzeichnet und etikettiert sein.
Alle ab dem 01.01.2021 produziertenLaBina^®-Pigmentierfarben werden selbstverständlich den Anforderungen entsprechen.

 

Wenn Sie im Besitz von LaBina^®-Pigmentierfarben sind, bitten wir folgendes zu beachten:

Die Flasche ist bereits geöffnet:
Die Farbe ist innerhalb von 12 Monaten nach dem Öffnungsdatum zu verbrauchen. In diesem Fall ist die LaBina^®-Pigmentierfarbe von den Änderungen durch die REACH-Verordnung nicht betroffen.

Die Flasche ist noch nicht geöffnet worden:
a.) Wenn Sie die LaBina^®-Pigmentierfarbe bis spätestens 04.01.2022 aufbrauchen, entstehen Ihnen durch die REACH-Verordnung keinerlei Nachteile.
b.) Für den Fall, dass Sie sich nicht sicher sind, ob Sie die Flasche bis zum 04.01.2022 aufbrauchen oder öffnen, bieten wir Ihnen einen Austausch der Flasche an. Bis zum 01.03.2021 können Sie die ungeöffnete LaBina^®-Pigmentierfarbe bei uns gegen eine neue Flasche mit dem gleichen Farbton austauschen lassen. Bitte kontrollieren Sie unbedingt, ob der Deckel der Pigmentierfarbe noch mit dem Sicherungsring fest verbunden ist und die Farbe noch mindestens bis 2022 haltbar ist. Dies sind die Voraussetzungen für den kostenfreien Austausch. Die Lieferung der neuen LaBina^® Pigmentierfarben erfolgt sobald die neu produzierten Pigmentierfarben bei uns eingetroffen sind.

Wichtig für Sie zu wissen ist, dass ab 04.01.2022 grundsätzlich alle Pigmentierfarben, egal von welchem Hersteller oder Händler, nicht mehr verwendet werden dürfen, wenn das Etikett auf der Flasche nicht REACH-konform ist oder die Rezeptur nicht der REACH-Verordnung entspricht. Ab diesem Zeitpunkt dürfen Sie nur noch Farben verwenden, die den rechtsstehenden Text in Ihrer Landessprache auf dem Etikett haben.

Legal information regarding the REACH Regulation

Dear Customers,
as you probably know, we produce our LaBina^® colours not only from the best raw materials and with thorough care, but we have always attached great importance to using safe, low-allergen ingredients and to transparency towards our customers.

We therefore welcome the fact that the EU’s REACH regulation now also applies to tattooing, microblading and permanent make-up colours. As a result of this regulation, a number of ingredients will be banned. While this has significant consequences for tattoo artists due to the ban of two important pigments (Green 7 & Blue 15), we only have to make minor adjustments to our LaBina^® pigmentation colours.

However, the change will come into effect at quite short notice on 04 January 2021. The final text of the regulation was only published in the Official Journal of the EU on 15 December 2020. The lead time of 20 days is extremely short to implement the changes that will apply from January 2021.

 

First things first:
If you use LaBina^® pigmentation colours, you are not directly affected by this at first. A sufficient transitional period of one year has been granted. Therefore, you can continue to use all LaBina^® pigmentation colours in your possession until 04 January 2022 without any restrictions imposed by the REACH regulation.

 

We would like to start by giving you as brief an introduction as possible to the subject matter. It helps to know where the relevant regulations can be found and how they are interrelated.

1.) Until now, the law applicable to permanent make-up was primarily regulated in the German Tattooing Products Ordinance (Tätowiermittelverordnung). Moreover, the Council of Europe Resolution ResAP(2008)1 “on requirements and criteria for the safety of tattoos and permanent make-up” sets the benchmark. This resolution regulates in particular minimum hygiene requirements and prohibits a number of ingredients.
2.) REACH was introduced as an EU regulation in 2007 and is therefore directly applicable law in all member states – in contrast to directives, which first have to be transposed into national laws. REACH stands for “Registration, Evaluation, Authorisation and Restriction of Chemicals” and has created a comprehensive system of classification of chemicals from all sectors. As of 04 January 2021, REACH will also apply to tattooing, microblading and permanent make-up inks. Beyond the Tattooing Products Regulation, no significant changes will result with regard to the banned ingredients for microblading and permanent make-up providers. For tattoo artists, the effects are much more serious; depending on the provider, between 60% and 100% of the inks will be eliminated from 2022 if the manufacturers do not replace large parts of their ingredients.
3.) The changes are governed by Appendix 13 of Annex XVII of REACH, which contains a list of prohibited ingredients. It has now been extended by the supplementary regulation coming into force on 04 January 2021 to include various substances exclusively related to the field of tattooing products, MB and PMU. The pigment Yellow 97 [CI 11767] used in some of our formulations for the production of LaBina^® pigmentation colours is no longer permitted after the transition period as of 04 January 2022. The pigment Green 36 [CI 74265] used by us complies with the regulation and may continue to be used. The pigment Blue 15 [CI 74160], which we also use to a very small extent, is still being reviewed and, according to the current status, may in any case be used until 03 January 2023. However, we assume that this pigment may continue to be used after this date, as the official examination by the responsible European Chemicals Agency (ECHA) has not yet provided all the necessary data and there are no indications that this pigment is dangerous.
4.) In the formulations of LaBina^® pigmentation colours in which the pigment Yellow 97 [CI 11767] is used, we will produce new pigmentation colours in the coming weeks with another yellow pigment that can be used without restrictions. The production of the new pigmentation colours will be completed by 01 March 2021 at the latest.
5.) From 04 January 2022, pigmentation colours must be produced, labelled and marked according to REACH requirements. All LaBina^® pigmentation colours produced from 01 January 2021 onwards will of course comply with the requirements.

 

If you are in possession of LaBina^® pigmentation colours, please note the following:

The bottle has already been opened:
The colour must be used within 12 months of the opening date. In this case, the LaBina^® pigmentation colour is not affected by the changes imposed by the REACH regulation.

 

The bottle has not yet been opened:
a.) If you use up the LaBina^® pigmentation colour by 04 January 2022 at the latest, you will not suffer any disadvantages as a result of the REACH regulation.
b.) If you are not sure whether you will use up or open the bottle by 04 January 2022,
we offer you the possibility to exchange the bottle. Until 01 March 2021 you can have the unopened LaBina^® pigmentation colour exchanged by us for a new bottle
with the same colour. Please make sure that the lid of the pigmentation colour is still firmly connected to the retaining ring and that the colour has a shelf life until
at least 2022. These are the requirements for a free exchange. The new LaBina^® pigmentation colours will be delivered as soon as we have received the newly produced pigmentation colours.

 

Please contact us by e-mail or telephone if you have any queries and before returning the product.

 

It is important for you to know that as of 04 January 2022, all pigmentation colours, regardless of the manufacturer or dealer, may no longer be used if the label on the bottle is not REACH-compliant or the formulation does not comply with the REACH regulation. From this point on, you may only use inks bearing the text shown on the right in your national language on the label.

Informations juridiques relatives au règlement REACH

Chère cliente, cher client,
comme vous le savez sans doute, nous produisons nos encres LaBina^® non seulement à partir des meilleures matières premières et avec un soin tout particulier, mais également en accordant depuis toujours une grande importance à l’utilisation d’ingrédients sûrs et peu allergènes et en faisant preuve de transparence envers nos clients.

Nous saluons donc le fait que le règlement REACH de l’UE s’applique désormais également aux encres de tatouage, de microblading et de maquillage permanent. Dans le cadre de ce règlement, un certain nombre d’ingrédients vont être interdits. Tandis que cette décision a des conséquences importantes pour les tatoueurs en raison de l’interdiction de deux pigments essentiels (Vert 7 et Bleu 15), nous n’avons à apporter que des ajustements mineurs à nos encres pigmentairesLaBina^®.

Cependant, le délai d’entrée en vigueur de ces modifications est relativement court, à savoir le 04/01/2021. Le texte final du règlement n’a été publié au Journal officiel de l’UE que le 15 décembre 2020. Le délai de 20 jours est extrêmement court pour mettre en oeuvre les modifications qui s’appliqueront à partir de janvier 2021.

 

Commençons par l’essentiel:
Si vous utilisez des encres pigmentaires LaBina^®, vous n’êtes dans un premier temps pas directement affecté. Une période de transition suffisante d’un an a été prévue. Vous pouvez donc continuer à utiliser toutes les encres pigmentaires LaBina^® en votre possession jusqu’au 04/01/2022 sans aucune restriction du fait du règlement REACH.

A ce stade, nous aimerions vous donner une entrée en matière aussi brève que possible. Il est utile de savoir où trouver les règlements pertinents et comment ils sont liés entre eux.

1.) Jusqu’à présent, la loi applicable au maquillage permanent était principalement régie par l’ordonnance allemande sur les produits de tatouage (Tätowiermittelverordnung). En outre, la résolution ResAP(2008)1 du Conseil de l’Europe « sur les exigences et les critères d’innocuité des tatouages et des maquillages permanents » sert de référence. Elle réglemente notamment les exigences minimales en matière d’hygiène et interdit un certain nombre d’ingrédients.
2.) En vigueur depuis 2007, REACH est un règlement de l’UE, soit une loi directement applicable dans tous les États membres – contrairement aux directives, qui doivent d’abord être transposées dans des lois nationales. REACH est un règlement concernant l’enregistrement, l’évaluation, l’autorisation et la restriction des substances chimiques qui a élaboré un système complet de classification des substances chimiques de tous les secteurs. À partir du 04/01/2021, REACH s’appliquera également aux encres de tatouage, de microblading et de maquillage permanent. Au-delà de l’ordonnance sur les produits de tatouage, aucun changement significatif n’est intervenu concernant les ingrédients interdits pour les fournisseurs de microblading et de maquillage permanent. Dans le cas des tatoueurs, les effets sont beaucoup plus graves ; en effet, selon le fournisseur, entre 60% et 100% des encres seront éliminées à partir de 2022 si les fabricants ne remplacent pas de grandes parties de leurs ingrédients.
3.) Les modifications sont régies par l’appendice 13 de l’annexe XVII de REACH. Il contient une liste des ingrédients interdits. Il a été étendu par le règlement complémentaire entrant en vigueur le 04/01/2021 pour inclure diverses substances exclusivement liées au domaine des produits de tatouage, de microblading et de maquillage permanent. Le pigment jaune Yellow 97 [CI 11767] utilisé dans certaines de nos formulations pour la production des encres pigmentaires LaBina^® ne sera plus autorisé après la période de transition à compter du 04/01/2022. Le pigment vert Green 36 [CI 74265] que nous utilisons est conforme au règlement et peut continuer à être utilisé. Le pigment bleu Blue 15 [CI 74160], que nous utilisons également dans une très faible mesure, fait encore l’objet de contrôles et, selon l’état actuel, peut en tout cas être utilisé jusqu’au 03/01/2023. Cependant, nous partons du principe que ce pigment pourra encore être utilisé après cette date, car l’examen officiel effectué par l’Agence européenne es produits chimiques (ECHA) responsable n’a pas encore fourni toutes les données nécessaires et rien n’indique à ce jour que ce pigment est dangereux.
4.) Dans les formulations des encres pigmentaires LaBina^® dans lesquelles le pigment jaune Yellow 97 [CI 11767] est utilisé, nous produirons dans les prochaines semaines de nouvelles encres avec un pigment jaune différent pouvant alors être utilisé sans restrictions. La production des nouvelles encres pigmentaires sera complétée au plus tard le 01/03/2021.
5.) À partir du 04/01/2022, les encres pigmentaires doivent être produites, marquées et étiquetées conformément aux exigences de REACH. Les encres pigmentaires LaBina^® produites après le 01/01/2021 seront bien sûr conformes aux exigences.

 

Si vous êtes en possession d’encres pigmentaires LaBina^®, veuillez observer ce qui suit :

 

Le flacon a déjà été ouvert:
L’encre doit être utilisée dans les 12 mois suivant la date d’ouverture. Dans ce cas,
l’encre pigmentaire LaBina^® n’est pas concernée par les modifications prévues par
le règlement REACH.

 

Le flacon n’a pas encore été ouvert :
a.) Si vous épuisez l’encre pigmentaire LaBina^® au plus tard le 04/01/2022, vous ne subirez aucun inconvénient du fait du règlement REACH.
b.) Au cas où vous ne seriez pas sûr si vous allez épuiser ou ouvrir le flacon avant le 04/01/2022, nous vous proposons un échange du flacon. Jusqu’au 01/03/2021, vous pouvez faire échanger le flacon d’encre pigmentaire LaBina^® non ouvert contre un nouveau flacon de la même teinte. Veillez à vérifier que le couvercle de l’encre pigmentaire est toujours fermement relié à l’anneau de retenue et que la date d’expiration de l’encre est d’au moins 2022. Telles sont les conditions requises pour un échange gratuit. Les nouvelles encres pigmentaires LaBina^® seront livrées dès que nous aurons reçu les encres pigmentaires nouvellement produites.

Il est important que vous sachiez qu’à partir du 04/01/2022, toutes les encres pigmentaires, quel que soit le fabricant ou le distributeur, ne peuvent plus être utilisées si l’étiquette du flacon n’est pas conforme à REACH ou si la formulation n’est pas conforme au règlement REACH. À partir de cette date, vous ne pourrez utiliser que des encres dont l’étiquette comporte le texte figurant à droite dans votre langue nationale.

Zoals u zeker al weet, produceren wij onze LaBina^®-tinten niet alleen op basis van de beste materialen en met de uiterste zorgvuldigheid, maar hechten we ook veel waarde aan veilige, allergeen-arme ingrediënten en aan transparantie tegenover onze klanten.

Daarom zijn we blij dat de REACH-verordening van de EU nu ook van toepassing is op tatoeage-, microblading- en permanente-make-up-tinten. Met deze richtlijn worden een aantal ingrediënten verboden. Dit heeft voor tatoeëerders ingrijpende gevolgen doordat twee belangrijke pigmenten (groen 7 en blauw 15) worden verboden. Bij LaBina^® hoeven we echter slechts kleine aanpassingen door te voeren in onze pigmenten.

De wijziging wordt echter wel al heel snel van kracht, op 04-01-2021 al. De uiteindelijke tekst van de richtlijn werd pas op 15 december 2020 gepubliceerd in de EU-documentatie. De verwerkingstijd was dus extreem kort, er waren slechts 20 dagen om de vanaf januari 2021 geldende wijzigingen door te voeren.

 

Dit is het belangrijkste:
Wanneer u LaBina^®-pigmenteertinten gebruikt, ondervindt u niet onmiddellijk gevolgen van de wijziging. Er is een redelijke overgangstermijn van een jaar. Daarom kunt u de LaBina^®-pigmenteertinten die u al in bezit heeft tot 04-01-2022 zonder beperkingen blijven gebruiken, ondanks de REACH-verordening.

Wij willen u graag een zo beknopt mogelijk overzicht van de situatie geven. Het helpt om te weten waar de betreffende voorschriften te vinden zijn en hoe ze op elkaar inwerken.

1.) Tot nog toe gold als toepasselijk recht voor permanente make-up in eerste instantie de Duitse tatoeageverordening. Daarnaast gold als norm van de kant van de Raad van Europa de resolutie ResAP(2008)1 ‚over de vereisten en criteria voor de veiligheid van tatoeages en permanente make-up‘.
Daarbij werden minimale vereisten gesteld aan de hygiëne en werden een aantal ingrediënten verboden.

2.) REACH is een sinds 2007 geldende EU-verordening die dus in alle lidstaten van kracht is, dit in tegenstelling tot richtlijnen die eerst in nationale wetgeving moeten worden omgezet.

REACH gaat over de ‚registratie, beoordeling, toelating en beperking van chemische stoffen‘; het gaat om een uitgebreid systeem van classificatie van chemicaliën op allerlei gebieden. Vanaf 04-01-2021 geldt de REACH ook voor tatoeage-, microblading- en permanente-make-up-tinten. In vergelijking met de Duitse tatoeageverordening zijn er geen wezenlijke veranderingen in de verboden ingrediënten voor microblading en permanente make-up waar aanbieders rekening mee moeten houden. Voor tatoeëerders zijn de gevolgen ingrijpender, zij zien vanaf 2022 tussen 60% en 100% van hun tinten wegvallen wanneer de fabrikanten niet grote delen van hun ingrediënten aanpassen.
3.) Maatgevend voor de wijzigingen is bijlage 13 van appendix XVII van de REACH. Deze bevat een lijst met verboden ingrediënten. Deze is nu door de op 04-01-2021 van kracht geworden aanvullende verordening uitgebreid met een aantal stoffen die uitsluitend te maken hebben met tatoeagemiddelen, microblading en permanente make-up. Het gele pigment Geel 97 [CI 11767], dat in sommige van onze samenstellingen voor de fabricage van LaBina^®-pigmenteertinten wordt gebruikt, is na de overgangstermijn vanaf 04-01-2022 niet meer toegelaten. Het door ons gebruikte pigment Groen 36 [CI 74265] voldoet aan de verordening en kan verder worden gebruikt. Het pigment Blauw 15 [CI 74160] dat wij in geringe hoeveelheden gebruiken, wordt nog getest en mag volgens de huidige regels eveneens nog tot 03-01-2023 worden gebruikt. We gaan ervan uit dat dit pigment ook na die datum verder mag worden gebruikt, omdat voor de ambtelijke controle door de verantwoordelijke Europese instantie voor chemicaliën ECHA alleen nog enkele vereiste gegevens ontbreken; er zijn tot op heden geen aanwijzingen dat dit pigment gevaar zou opleveren.
4.) In de samenstellingen van LaBina^®-pigmenteertinten waarin het pigment Geel 97 [CI 11767] wordt gebruikt, gaan wij in de komende weken met een onbeperkt bruikbaar ander geel pigment nieuwe pigmenteertinten fabriceren. De productie van de nieuwe pigmenteertinten zal uiterlijk 01-03-2021 voltooid zijn.
5.) Vanaf 04-01-2022 moeten pigmenteertinten volgens de regels van de REACH worden geproduceerd, gekenmerkt en geëtiketteerd. Alle vanaf 01-01-2021 geproduceerde LaBina^®-pigmenteertinten zullen uiteraard aan de vereisten voldoen.

 

Wanneer u LaBina^®-pigmenteertinten bezit, let dan op de volgende punten:

Gebruik de tint binnen 12 maanden na datum van openen. In dat geval valt de LaBina^®-pigmenteertint niet onder de wijzigingen van de REACH-verordening.

a.) Wanneer u de LaBina^®-pigmenteertint vóór 04-01-2022 opmaakt, ondervindt u geen nadeel van de REACH-verordening.
b.) Wanneer u niet zeker weet of u het flesje voor 04-01-2022 opmaakt of opent, kunt u het bij ons ruilen. Tot 01-03-2021 kunt u ongeopende LaBina^®-pigmenteertinten ruilen tegen een nieuw flesje met dezelfde tint. Controleer altijd of de deksel van de pigmenteertint nog vastzit aan de verzegelingsring en dat de tint nog minstens tot 2022 houdbaar is. Dat zijn de voorwaarden voor gratis omruilen. De levering van de nieuwe LaBina^®-pigmenteertinten volgt zodra de nieuw geproduceerde pigmenteertinten bij ons zijn binnengekomen.

Het is belangrijk om te weten dat vanaf 04-01-2022 alle pigmenteertinten, ongeacht de producent of verkoper, niet meer gebruikt mogen worden wanneer het etiket op het flesje niet aan de REACH voldoet of als de samenstelling niet voldoet aan de REACH-verordening. Vanaf dat moment mag u alleen nog tinten gebruiken waarop de hier rechts vermelde tekst in de taal van uw land is vermeld op het etiket.

 

Deze tekst is juridisch voorgeschreven en moet dus altijd op het etiket staan!

Note legali sul regolamento REACH

Cari clienti,
come certamente saprete, noi produciamo i nostri colori LaBina®non solo con le migliori materie prime e con la massima cura, ma anche attribuendo sempre la massima importanza all’uso di ingredienti sicuri e a basso contenuto di allergeni e alla trasparenza nei confronti della nostra clientela.

Pertanto, accogliamo con favore il fatto che il regolamento REACH dell’Unione europea ora trovi applicazione anche per i colori che vengono utilizzati per i tatuaggi, il microblading e il trucco semipermanente. In base a questo regolamento saranno vietati anche tutta una serie di ingredienti. Mentre per i tatuatori ciò comporta gravose conseguenze, essendo stati vietati due colori importanti (Verde 7 e Blu 15), per i nostri colori per dermopigmentazione LaBina®noi dovremo adeguarci solo in misura contenuta.

Il cambiamento, tuttavia, entrerà in vigore il 04/01/2021 e quindi in tempi brevissimi. Il testo definitivo del regolamento è stato pubblicato sulla Gazzetta ufficiale dell’Unione europea solo il 15 dicembre 2020. Il tempo di soli 20 giorni che ci rimane per attuare i cambiamenti vigenti da gennaio 2021 è estremamente breve.

 

Partiamo dagli aspetti più importanti:
Se utilizzate i colori per dermopigmentazione LaBina®, per il momento, non siete interessati direttamente dal provvedimento. È previsto un periodo di transizione di un anno sufficientemente lungo. Pertanto, potrete continuare ad utilizzare tutti i colori per dermopigmentazione LaBina® in vostro possessofino al 04/01/2022 senza alcuna limitazione dettata dal regolamento REACH.

In questa fase è nostro desiderio, innanzitutto, agevolarvi il più possibile nel passaggio alla nuova normativa. È utile sapere in quali norme sono contenute le disposizioni vigenti e come queste sono correlate.

1) Ad oggi la materia, per quanto riguarda il trucco semipermanente, è disciplinata in primo luogo dalla normativa tedesca sui tatuaggi. Oltre ad essa si applica, come stato della tecnica riconosciuto da parte del Consiglio d’Europa, la risoluzione ResAP(2008)1 „sui requisiti e criteri per la sicurezza dei tatuaggi e del trucco semipermanente“.
Essa prescrive in particolare i requisiti minimi di igiene e vieta una serie di ingredienti.

2) Il REACH è un regolamento dell’Unione europea in vigore dal 2007 e come tale una legislazione vigente in modo diretto in tutti gli Stati membri, a differenza delle linee guida che devono prima essere recepite nel diritto interno dei vari paesi. Il regolamento REACH riguarda la “registrazione, valutazione, autorizzazione e restrizione delle sostanze chimiche” e ha portato alla creazione di un sistema completo di classificazione delle sostanze chimiche di tutti i settori. A partire dal 04/01/2021, il regolamento REACH sarà applicato anche ai colori utilizzati per i tatuaggi, il microblading e il trucco semipermanente. Al di là della normativa sui tatuaggi, relativamente agli ingredienti proibiti, per chi pratica i trattamenti di microblading e trucco semipermanente non vi sono cambiamenti significativi. Per i tatuatori le conseguenze sono molto più gravose, poiché per questi, a seconda dell’offerente, dal 2022 tra il 60% e il 100% dei colori scompariranno se i rispettivi produttori non sostituiranno grandi quantità degli ingredienti attualmente utilizzati.
3) Determinante per i cambiamenti è l’allegato XVII del regolamento REACH. Esso contiene un elenco di ingredienti non autorizzati. Recentemente esso è stato esteso, con il regolamento integrativo che entrerà in vigore il 04/01/2021, a varie sostanze correlate esclusivamente al settore dei tatuaggi, del microblading e del trucco semipermanente. L’uso del pigmento Yellow 97 [CI 11767], utilizzato in alcune formulazioni per la produzione di colori per dermopigmentazione LaBina®, al termine del periodo di transizione, a partire dal 04/01/2022 non sarà più consentito. Il pigmento Verde 36 [CI 74265] da noi utilizzato è conforme alla normativa e si potrà continuare ad utilizzare. Il pigmento Blu 15 [CI 74160], anch’esso da noi utilizzato, ma in misura molto limitata, è ancora in fase di valutazione e, allo stato attuale, può in ogni caso essere ancora utilizzato fino al 03/01/2023. Riteniamo, tuttavia, che questo pigmento si potrà continuare ad utilizzare anche oltre tale data, non essendo ancora disponibili tutti i dati necessari per i controlli ufficiali da parte dell’agenzia europea competente per le sostanze chimiche ECHA e non essendo emersi ad oggi elementi che dimostrino un’eventuale pericolosità di questo pigmento.
4) Per quanto riguarda le formulazioni di colori per dermopigmentazione LaBina® nelle quali è utilizzato il pigmento giallo Yellow 97 [CI 11767], nelle prossime settimane produrremo dei nuovi colori per dermopigmentazione con un nuovo pigmento utilizzabile senza alcuna restrizione. La produzione dei nuovi colori per dermopigmentazione sarà ultimata entro il 01/03/2021.
5) A partire dal 04/01/2022 i colori per dermopigmentazione dovranno essere identificati ed etichettati secondo quanto previsto dal regolamento REACH.

Tutti i colori per dermopigmentazione LaBina® prodotti a partire dal 01/01/2021 saranno naturalmente conformi alle nuove disposizioni.

 

Se siete in possesso di colori per dermopigmentazione LaBina®-, vi preghiamo di osservare quanto segue:

Il flacone è già aperto:
Il colore deve essere utilizzato entro 12 mesi dalla data di apertura. In questo caso il colore per dermopigmentazione LaBina®non è interessato dal cambiamento dettato dal regolamento REACH.

Il flacone non è ancora stato aperto:
a.) Se esaurirete il colore per dermopigmentazione LaBina®entro il 04/01/2022 l’applicazione del regolamento REACH non vi arrecherà alcuno svantaggio.
b.) Qualora non siate sicuri o non sappiate ancora se esaurirete il contenuto del flacone entro il 04/01/2022, vi offriamo la possibilità di sostituire il flacone. Fino al 01/03/2021 potrete richiedere la sostituzione delle confezioni di colore per dermopigmentazione LaBina® non ancora aperte con flaconi nuovi della stessa tonalità di colore. Vi preghiamo di controllare tassativamente che il tappino sia ancora sigillato e saldamente unito all’anello di sicurezza e che il colore non scada prima del 2022. Queste sono le condizioni necessarie per poter beneficiare della sostituzione gratuita. La consegna dei nuovi colori per dermopigmentazione LaBina seguirà non appena riceveremo i colori di nuova produzione.

 

Per eventuali delucidazioni e prima di rispedire i prodotti per la sostituzione, vi preghiamo di contattarci tramite e-mail o telefonicamente.

 

L’importante è che voi sappiate che, a partire dal 04/01/2022, in linea generale, tutti i colori per dermopigmentazione, indipendentemente dal produttore o dal rivenditore, non potranno più essere utilizzati se l’etichetta applicata sul flacone non sarà conforme allo standard REACH o se la formulazione non sarà conforme a quanto specificato dal regolamento stesso. A partire dalla suddetta data potrete utilizzare solo i colori corredati di un etichetta con il testo riportato a destra nella lingua del vostro paese.

Informações legais sobre o regulamento REACH

 

Caros clientes,
como você provavelmente já sabem, nós produzimos as nossas cores LaBina^® não só com as melhores matérias-primas e com muito cuidado, mas sempre atribuímos grande importância aos ingredientes seguros, anti-alérgicos e à transparência para os nossos clientes.

Saudamos, portanto, o fato de que o regulamento REACH da UE agora também se aplica para tintas de tatuagem, microblading e de maquilhagem permanente. Este regulamento também proíbe uma série de ingredientes. Embora isso tenha consequências significativas para o tatuador, ao proibir dois pigmentos importantes (Verde 7 e Azul 15), nas nossas cores de pigmentação LaBina^® apenas temos que fazer uma pequena adaptação.

No entanto, em curto prazo, a mudança entrará em vigor a partir de 4 de janeiro de 2021. O texto final do regulamento só foi publicado no Diário Oficial da União Europeia em 15 de dezembro de 2020. O prazo de 20 dias é extremamente curto para implementar as alterações que serão aplicadas a partir de janeiro de 2021.

O mais importante com antecedência:
Se você utiliza cores de pigmentação LaBina^®, não estará imediatamente afetado por isso. Existe um período de transição suficiente de um ano. Por causa disso, você pode continuar a utilizar todas as cores de pigmentação LaBina^® até 4 de janeiro de 2022 sem restrições devido ao regulamento REACH.

Neste ponto, gostaríamos de lhe dar a mais breve introdução possível ao assunto. Ajuda saber onde encontrar os regulamentos relevantes e como eles estão inter-relacionados.

1.) Até agora, a lei que rege para a maquilhagem permanente foi regulamentada principalmente pelo decreto alemão para tintas de tatuagem. Além disso, o estado atual por parte do Conselho Europeu é a Resolução ResAP (2008) 1 „sobre os requisitos e critérios para a segurança de tatuagens e maquilhagem permanente.“
Em particular, isso regula os requisitos mínimos de higiene e proíbe uma série de ingredientes.

2.) O REACH é um regulamento da UE que está em vigor desde 2007, ou seja, a lei diretamente aplicável em todos os estados membros, em contraste com as diretivas que devem ser implementadas apenas em as leis nacionais. O REACH diz respeito ao „registo, avaliação, autorização e restrição de substâncias químicas“ e criou um sistema abrangente para a classificação de produtos químicos de todas as áreas. A partir de 4 de janeiro de 2021, o REACH também se aplicará a tatuagem, microblading e cores de maquilhagem permanente. Não há mudanças significativas nos ingredientes proibidos para fornecedores de microblading e maquilhagem permanente além do regulamento das tintas de tatuagem. Para os tatuadores, os efeitos são muito mais graves, a depender do fornecedor, entre 60% e 100% das cores desaparecerão a partir de 2022 se os fabricantes não substituírem grande parte de seus ingredientes.
3.) O Apêndice 13 do Anexo XVII do REACH é decisivo para as mudanças. Este contém uma lista de ingredientes proibidos. Agora foi ampliado para incluir várias substâncias relacionadas exclusivamente ao campo das tintas de tatuagem, microblading e maquilhagem permanente pela portaria complementar que entrará em vigor em 4 de janeiro de 2021. Em algumas de nossas receitas para a produção das cores de pigmentação LaBina^® o pigmento amarelo Yellow 97 [CI 11767] usado não é mais permitido após o período de transição de 5 de janeiro de 2022. O pigmento verde 36 [CI 74265] que usamos está em conformidade com a regulamentação e pode continuar a ser usado. O pigmento azul 15 [CI 74160], que também usamos de forma muito limitada, ainda está sendo testado e, de acordo com o estado atual, pode ser usado pelo menos até 03.01.2023. No entanto, presumimos que esse pigmento poderá continuar a ser usado após esse período, uma vez que o teste oficial da autoridade europeia responsável por produtos químicos ECHA ainda não forneceu todos os dados necessários e, até agora, não houve indicações de que esse pigmento seja perigoso.
4.) Nas receitas das cores de pigmentação LaBina^®, nas que o pigmento amarelo Yellow 97 [CI 11767] é usado, estaremos produzindo novas cores de pigmentação nas próximas semanas com outro pigmento amarelo que pode ser usado sem restrições. A produção das novas cores de pigmentação será concluída em 1º de março de 2021, o mais tardar.
5.) A partir de 4 de janeiro de 2022, as tintas pigmentadas devem ser produzidas, marcadas e rotuladas de acordo com as especificações do REACH. Todas as cores de pigmentação LaBina^® produzidas a partir de 01/01/2021 naturalmente atenderão aos requisitos.

 

Se você possui cores de pigmentação LaBina^®, por favor, observe o seguinte:

O frasco já está aberto:
A tinta deve ser usada dentro de 12 meses depois de aberto. Neste caso, a cor da pigmentação LaBina^® não é afetada pelas mudanças causadas pelo regulamento REACH.

O frasco ainda não foi aberto:
a.) Se você consumir a cor de pigmentação LaBina^® até 04/01/2022, o mais tardar, não haverá quaisquer desvantagens devido ao regulamento REACH.
b.) Caso você não tenha certeza se vai esgotar ou abrir o frasco até 4 de janeiro de 2022, oferecemos a você a substituição do frasco. Até 1º de março de 2021 você pode trocar a cor de pigmentação LaBina^® fechada
por um novo frasco da mesma cor. Certifique-se de que a tampa da cor de pigmentação ainda esteja firmemente presa ao anel de travamento e que a tinta tenha uma data de validade pelo menos até 2022. Estes são os pré-requisitos para a troca gratuita. As novas cores de pigmentação LaBina^® são fornecidas assim que recebermos as novas cores de pigmentação produzidas.

É importante que você saiba que a partir de 4 de janeiro de 2022, todas as cores de pigmentação, independentemente do fabricante ou distribuidor, não podem mais ser utilizadas se o rótulo do frasco não estiver em conformidade com o REACH ou a formulação não estiver em conformidade com o regulamento REACH. A partir desta data você só poderá usar cores que tenham o texto à direita no seu idioma local na etiqueta.

Aviso legal sobre el reglamento REACH

Estimadas/os clientes:
Como ya sabe, no solo producimos nuestros colores LaBina^® a partir de las mejores materias primas y con gran esmero, sino que siempre hemos puesto el mayor énfasis en el uso de ingredientes seguros, con bajo contenido en alérgenos, así como en la transparencia para con los clientes.

Por lo tanto, nos complace que el reglamento REACH de la UE se aplique ahora también a los colores para tatuajes, microblading y colores para maquillaje permanente. Este reglamento también prohíbe una serie de ingredientes. Si bien esto tiene consecuencias considerables para los tatuadores, debido a la prohibición de dos pigmentos importantes (verde 7 y azul 15), en nuestro caso solo son necesarias ligeras adaptaciones para nuestros colores de pigmentación LaBina^®.

Sin embargo, ahora la enmienda entrará en vigor a muy corto plazo, a partir del 04.01.2021. El texto definitivo del reglamento no se publicó en el Boletín Oficial de la UE hasta el 15 de diciembre de 2020. 20 días es un plazo extremadamente reducido para introducir los cambios vigentes a partir de enero de 2021.

 

Lo más importante de entrada:
Si utiliza colores de pigmentación LaBina^®, esto no le afectará directamente por el momento. Hay un período de transición suficiente de un año. Por lo tanto, puede seguir utilizando todos los colores de pigmentación LaBina^® de los que disponga en stock hasta el 04.01.2022 sin restricciones derivadas del reglamento REACH.

En este punto, en primer lugar, queremos proporcionarle una introducción lo más breve posible en la materia. Le ayudará saber dónde figuran las normas pertinentes y la relación que guardan entre ellas.
1.) Hasta ahora, la legislación aplicable al maquillaje permanente se basaba principalmente en el Reglamento alemán sobre tatuajes. Además, se considera que la resolución del Consejo Europeo ResAP(2008)1 “sobre los requisitos y criterios de seguridad del tatuaje y el maquillaje permanente” es el estado de la técnica.
En particular, regula los requisitos mínimos de higiene y prohíbe una serie de ingredientes.
2.) REACH es un reglamento de la UE que lleva en vigor desde 2007, es decir, que es directamente aplicable en todos los Estados miembros, a diferencia de las directivas que se deben convertir primero en leyes nacionales. REACH afecta el “registro, evaluación, autorización y restricción de sustancias y preparados químicos”. Ha generado un sistema completo de clasificación de las sustancias y preparados químicos en todos los ámbitos. A partir del 04.01.2021, REACH se aplicará también a los tatuajes, microblading y colores de maquillaje permanente. Más allá del Reglamento sobre tatuajes, no se introducen cambios importantes en cuanto a los ingredientes prohibidos para los proveedores de microblading y de maquillaje permanente. En el caso de los tatuadores, los efectos son mucho más graves: en función del proveedor, se deberán suprimir entre el 60 y el 100 % de los colores a partir de 2022, si los fabricantes no sustituyen gran parte de sus ingredientes.
3.) Los cambios se rigen por el Anexo 13 del Apéndice XVII de REACH. Este contiene una lista de ingredientes no permitidos. Ahora se ha ampliado a varias sustancias relacionadas exclusivamente con los tatuajes, el microblading y el maquillaje permanente, por medio del reglamento complementario que entró en vigor el 04.01.2021. El pigmento amarillo Yellow 97 [CI 11767] utilizado en algunas de nuestras formulaciones para la elaboración de colores de pigmentación LaBina^® ya no estará permitido una vez concluido el período de transición, es decir, a partir del 04.01.2022. El pigmento verde 36 [CI 74265] que utilizamos cumple el reglamento y puede seguir utilizándose. El pigmento azul 15 [CI 74160], que también hemos utilizado en muy poca medida, sigue siendo objeto de ensayo y, en cualquier caso, puede utilizarse hasta el 03.01.2023. Sin embargo, esperamos que este pigmento pueda seguir utilizándose después de esa fecha, ya que la comprobación oficial de la ECHA, la autoridad europea competente en materia de sustancias químicas no dispone aún de todos los datos necesarios, y hasta ahora no se ha demostrado que este pigmento entrañe ningún peligro.
4.) En las formulaciones de los pigmentos LaBina^® en los que se utiliza el pigmento amarillo Yellow 97 [CI 11767], fabricaremos nuevos colores de pigmentación en las próximas semanas con un pigmento diferente que se podrá utilizar sin restricciones. La fabricación de los nuevos colores de pigmentación se completará a más tardar el 01.03.2021.
5.) A partir del 04.01.2022, las pinturas de pigmentación se deberán producir, identificar y etiquetar según las especificaciones de REACH. Naturalmente, todos los colores de pigmentación LaBina^® producidos a partir del 01.01.2021 se ajustarán a los requisitos.

 

Si tiene en stock colores de pigmentación LaBina^®, le rogamos que tenga en cuenta lo siguiente:

El frasco ya está abierto:
El color se deberá utilizar en un plazo de 12 meses a partir de la fecha de apertura. En este caso, el color de pigmentación LaBina^® no se ve afectado por las modificaciones introducidas por el reglamento REACH.

El frasco aún no se ha abierto:
a) Si utiliza el color de pigmentación LaBina^® como máximo hasta el 04.01.2022, el reglamento REACH no le afectará.
b) En caso de que no esté seguro de si utilizará o abrirá el frasco antes del 04.01.2022, le ofrecemos una sustitución del frasco. Hasta el 01.03.2021, puede cambiar el color de pigmentación LaBina^® sin abrir por un nuevo frasco con el mismo tono de color. Es imprescindible que compruebe si la tapa del color de pigmentación está firmemente unida al anillo de seguridad y si el color no caduca hasta 2022. Estos son los requisitos para la sustitución gratuita. Los nuevos colores de pigmentación LaBina^® se suministrarán cuando los hayamos recibido.

Es importante que sepa que, a partir del 04.01.2022, todos los colores de pigmentación, independientemente del fabricante o distribuidor, ya no podrán utilizarse si la etiqueta del frasco no cumple los requisitos REACH, o si la fórmula no cumple el reglamento REACH. A partir de ese momento, solo podrá utilizar colores que presenten en la etiqueta el texto redactado en su idioma que figura a la derecha.
